What is COBRA Medical Insurance?
COBRA is an insurance benefit passed by the federal government in 1985. Employees who leave their job voluntarily or for any reason other than gross misconduct, spouses of these employees, dependent children of these employees and disabled persons are entitled to COBRA Medical Insurance under the law. COBRA is not an insurance agency, it’s not a government bureau and it’s not a help center. COBRA is merely a law that your employer has to comply with, but as in all things the law is not always on your side. If your employer chooses to not follow this law, to win back your rights can not only be expensive but hard and time consuming.
One of the crucial rights a former employee is granted by COBRA is that former employers are required to notify past workers of their Cobra Health Insurance rights within 30 days of employment termination. Employers who violate this statute can receive severe fines and penalties, subject to you (as a former employee) proving they actually did not notify you. If the employee, spouse or dependent exercises their right to Cobra Medical Insurance, neither the insurance provider nor the employer is required to notify the former employee of premiums that are due. If a former employee does not pay their premiums on time, is late even by one day, the former employer has the right to take the former employee off of COBRA. This is one of the biggest reason people get kicked off of COBRA, coupled with improper notification.
What should I do while on Cobra Medical Insurance?
Pay your premiums and do your research!
Many people simply pay their COBRA premiums without doing their research. There are two things that a COBRA beneficiary must look into if they are on COBRA or about to go on COBRA.
- If you are perfectly health, being on Cobra Health Insurance may not be the best option. COBRA is a tool that can be used, but only in the right situations. If you, as a former employee or a dependent of a former employee, are in good health a regular major medical plan may be your best option.
- If you or one of your dependents is not in good health, staying on Cobra Medical Insurance is your only option. If you do not elect COBRA, you will not be able to get a private major medical insurance plan. COBRA allows you to maintain insurance even though you may have pre-existing conditions. If you, or one of your dependents, have any medical condition, elect your COBRA.
